1. Concept and legal basis

Article 273. Exploitation of child labor. – The penalty of prision correccional in its minimum and medium periods and a fine not exceeding 500 pesos shall be imposed upon anyone who, under the pretext of reimbursing himself of a debt incurred by an ascendant, guardian or person entrusted with the custody of a minor, shall, against the latter’s will, retain him in his service. (Act 3815, Revised Penal Code)

2. Elements of the offense

Elements of the offense:

1) The offender retains him in his service a minor;

2) It is against the minor’s will; and,

3) It is under the pretext of reimbursing himself of a debt incurred by an ascendant, guardian or person entrusted with the custody of the minor.(Article 273, Act No. 3815, Revised Penal Code)
