Section 48, Canon III

SECTION 48. Compensation for counsel de officio. – Subject to availability of funds as may be provided by law, the court may, in its discretion, order a lawyer engaged as counsel de officio to be compensated in such sum as the court may fix following Canon III, Section 41, provided that it is not covered by the provision on Limited Legal Services. 1. Compensation for counsel de officio

Lawyers engaged as counsel de officio are “to be compensated in such sum as the court may fix following Canon III, Section 41, provided that it is not covered by the provision on Limited Legal Services.”

The compensation for counsel de officio is subject to:

1) Availability of funds as may be provided by law; and

2) Discretion of the court who made the appointment.
