Section 41, Canon VI
SECTION 41. Payment of fines and return of client’s money and property. – When the penalty imposed is a fine or the respondent is ordered to return the client’s money or property, the respondent shall pay or return it within a period not exceeding three (3) months from receipt of the decision or resolution. If unpaid or unreturned, the Court may cite the respondent in indirect contempt. (2023 Code of Professional Responsibility and Accountability or CPRA)
1. Payment of fines and return of client’s money and property
a. 3-month to pay or return
If the decision imposed a penalty of a fine or an order to return the client’s money or property, the respondent has to do so “within a period not exceeding three (3) months from receipt of the decision or resolution.”
b. Indirect contempt
The respondents may be cited for indirect contempt if they are unable to pay the fine or return the client’s money or property.
