Revealing secrets with abuse of office, Revised Penal Code

1. Concept and legal basis

Art. 291. Revealing secrets with abuse of office. – The penalty of arresto mayor and a fine not exceeding One hundred thousand pesos (₱100,000) shall be imposed upon any manager, employee or servant who, in such capacity, shall learn the secrets of his principal or master and shall reveal such secrets. (Act 3815, Revised Penal Code, as amended by R.A. 10951)

2. Elements of the offense

Elements of the offense:

1) The offender is a manager, employee, or servant;

2) In such capacity, he learns the secrets of his principal or master; and,

3) He reveals such secrets. (Article 291, Act No. 3815, Revised Penal Code)
